Expert Witness Reports
Where it has not been possible to resolve a dispute without recourse to solicitors, an Expert Witness may be required. An Expert Witness’s overriding duty is to the court or tribunal, and they must provide independent, impartial and unbiased evidence.
An Expert Witness should be familiar with Part 35 of the Civil Procedure Rules, the accompanying practice direction including the Protocol for the Instruction of Experts to give Evidence in Civil Claims, the Practice Direction Pre-Action Conduct, and Surveyors acting as Expert Witnesses: RICS Practice Statement (Fourth Edition).
